Introduction & Acceptance. These Terms & Conditions (“Terms”) govern your use of the Samuel Tutor website and services. By creating a member account, booking a session, purchasing a package, or attending any lesson, you agree to these Terms.

Business Communications: We prefer to communicate via email. By accepting these Terms, you agree that email can be used as a durable medium for providing you with any required information (including contract confirmations, notices, etc.).
2. 服务、预约与合同成立

Services Offered: We provide online English tutoring services (including conversation practice, exam preparation, etc.) delivered by live video call. Lessons are one-to-one and conducted via platforms like DingTalk, Zoom, or Google Meet. No in-person or physical delivery – all sessions are remote/digital. The standard lesson length is 45 minutes of teaching time.

Booking System: All sessions must be booked through our online system (Wix Bookings member portal). You will need a member account (the “Student Portal”) to purchase lesson plans, access your lesson credits, view your booking history, reschedule or cancel sessions, and download receipts/invoices. Availability is shown in both your local time and UK time (GMT or BST); your confirmation email will state the lesson time with the time zone for clarity.

Immediate Use of Credits: Once you purchase a lesson package (see Section 5), the lesson credits are issued to your account without delay. You can use them to book sessions right away (subject to the advance booking rules below). There is no mandatory waiting period to start scheduling lessons.

How to Place an Order (and correct errors): To purchase tutoring services, you will follow these steps:

Select a lesson package (e.g. a single lesson or a bundle) and add it to your cart.

Provide scheduling preferences: After purchase, you can choose a session time from the calendar in your account. (If you’re buying a bundle, you can schedule multiple lessons using the credits issued to you as part of the package.)

Review Order Details: Before confirming your purchase, you will see an order summary, including the package contents and total price. Please check that your personal details and order details are correct. You have the opportunity to correct any mistakes at this stage – you can edit information, remove items from the cart, or go back to previous steps if needed.

Complete Payment: When you are happy with the order, you will proceed to payment. By clicking the final “Pay Now” or equivalent button, you are making an offer to buy the selected services for the stated price. You will explicitly acknowledge at checkout that placing the order incurs an obligation to pay (this is made clear by the button label and/or a checkbox agreement).

Order Acknowledgement: After you place your order and payment is processed, we will acknowledge receipt of your order by email without undue delay. This is an automated order receipt.

Order Confirmation & Contract Formation: We will then review your order (to ensure, for example, that there are no obvious pricing errors) and send you an order confirmation email. The contract between us is only formed at the moment we send this confirmation email (up until then, your order may remain an offer on your side). We aim to send the confirmation email quickly (usually within minutes of the acknowledgement). The confirmation email will also contain a copy of (or link to) these Terms on a durable medium for your records (see Section 17). If we cannot accept your order for some reason (e.g. a technical error in pricing/availability – see Section 15), we will inform you and refund any payment.

Contract Storage & Access: We electronically store the details of each order/booking and the applicable Terms. As a registered student, you can log in to your member account to see your purchase history and upcoming lessons, and you can download receipts or invoices for your payments. A copy of these Terms is always accessible on our website (footer link), and we will email you a link to the Terms with each order confirmation for your reference. If you ever need another copy of these Terms or your order details, you can request it by emailing us (see Section 1 for contact info). We encourage you to save or print a copy of these Terms for your own records as well (they constitute the contract between us).
3. 试听课(仅限新学员)
We offer a trial lesson option for new students to experience our tutoring service:

Trial Length: We have a 15-minute trial.

Eligibility: Each new student is entitled to one trial lesson. Trials are not available if you have already taken a trial or if you are an existing paying student. Trial credits are non-transferable (only the intended student may use the trial).

How to Get a Trial: You must “purchase” (for free) the trial lesson package on our site. This will grant a trial lesson credit to your account, which you can then use to book a session in the usual way.

Validity: Trial lesson credits expire 1 month after being issued. Please schedule and take your trial within one month of obtaining it, otherwise the trial credit will expire and cannot be used.

Important: We recommend using your trial lesson before purchasing any paid package. The trial is there for you to assess the tutor’s service. After the trial, if you wish to continue, you can choose a suitable paid package (see Section 5). Trial lessons are limited to one per person.
4. 价格、付款与税费

Currency: All prices for lessons and packages are listed in Pound Sterling (GBP). If you are viewing from overseas, be aware the charge will be converted to GBP. There are no hidden fees or taxes added on top of the listed price – the price you see is the final price (subject to any currency conversion by your bank, see “Cross-border payments” below).

Tax Status: We are not VAT-registered, which means no VAT is charged on our prices. The price is the same for UK and non-UK customers. (If in future we become VAT-registered, we will update this section; currently, under the UK VAT registration threshold, we do not add VAT.)

Upfront Payment: All lesson packages must be paid in full upfront. This is a one-off charge (we do not use recurring subscriptions for lessons). You purchase credits for a set number of lessons (see Section 5) and can then use those credits to book sessions. There is no ongoing payment obligation beyond the initial purchase unless you decide to buy more lessons later.

Payment Methods: We accept major payment methods, including credit/debit cards. We may also accept Alipay for students who use that platform. All payments are handled securely via our payment processors. We do NOT add any surcharge or extra fee for using a particular payment method – the price is the same regardless of payment type. (Note: your bank or card issuer may levy currency conversion fees if you pay in a non-GBP currency – see “Cross-border payments” below.)

No Card on File for Penalties: For your security, we do not store your card details ourselves, and we never take any deposit or card authorisation for “penalty” charges. In other words, we will not charge your card later for a late cancellation or similar – the only charges we ever make are those you authorise when purchasing lessons. (Our late cancellation policy instead involves losing a lesson credit, see Section 7, rather than extra fees).

Promotions & Discounts: From time to time, we may offer promo codes, referral discounts, or special offers. Unless stated otherwise, promotional discounts apply only to new purchases within the promo period and cannot be applied retroactively to past purchases. All promotions have an expiration date or cap, and we reserve the right to modify or withdraw promotions at any time. Only one promo can be used per purchase (unless explicitly allowed).

Price Changes: We may update our standard prices occasionally (for example, if we introduce new services or adjust for market conditions). Any price change will not affect you if you have already purchased a package – it would apply only to new purchases going forward. We do not raise prices retroactively on credits you have already bought. If our prices change, the new rates will be clearly displayed on the website for future orders.

Cross-Border Payments: We welcome international students. If you are paying from outside the UK in a different currency, you can still pay using the methods above – the amount will be converted to GBP by your bank or the payment provider. You are responsible for any currency conversion fees or foreign transaction fees charged by your bank. (For example, if you pay via Alipay through a payment processor, the payment processor/Alipay will handle conversion to GBP; if you pay via a payment processor with a non-GBP card, the payment processor's conversion rates apply.) We always charge the exact GBP price shown, and any difference you see on your statement is due to exchange rates or fees from your bank.
5. 课程套餐、课时次数与有效期

Lesson Packages (“Plans”): We sell lessons in defined packages (for example: 1 lesson, 5 lessons, 10 lessons, up to 20 lessons packages). Each standard lesson is 45 minutes of tutoring time (plus the 15-minute buffer as noted in Section 2). When you buy a package, your account is credited with a number of “lesson credits” equal to the number of lessons in the package. One lesson = one credit. Each credit can be redeemed to book one 45-minute session.

Using Credits: When you attend a scheduled lesson, one credit is deducted from your account at the end of the session. If you book a lesson but fail to attend or cancel late, one credit may be deducted as a no-show fee (see Section 7 on cancellation policy). All credits are electronic and tied to your member account.

Credit Applicability (Service Types): We may offer different plan types (for instance, an “IELTS Preparation Plan” vs. a “Free Talk Conversation Plan”). If so, the credits you purchase under a specific plan can be used for the types of lessons described in that plan. For example, credits issued as part of an “IELTS Lesson Plan” can be used to book either IELTS Prep lessons or general English conversation lessons (Free Talk). Credits issued as part of a “Free Talk Lesson Plan” can be used to book Free Talk lessons only (not IELTS Prep) unless otherwise noted. If we offer any speciality or tailored sessions, the plan description will state whether your credits can be used for those. In summary, credits are flexible within the scope of the plan you bought, but not across different service categories unless explicitly allowed.

Credit Expiry (“Use By” Date): All lesson credits expire after a certain period from the purchase date. Unless a different period is stated for a particular promotion or plan, the default expiry is: 12 months for paid packages, and 1 month for a trial lesson credit (as noted in Section 3). This means you must schedule and take your lessons within that time. After expiry, unused credits will be forfeited – they become invalid and cannot be used or refunded. We believe the default period (a full year for paid credits) is sufficient for scheduling your lessons at a comfortable pace. (If you face special circumstances that prevent you from using credits in time, see Section 8 on possible extensions.)

No Transfer or Resale of Credits: Your lesson credits are personal to you. You cannot sell, trade, or gift them to anyone else. (The contract for services is between us and you, the student or their parent/guardian.) If you have multiple family members taking lessons, please create separate accounts or let us know to arrange an appropriate package – don’t share login credentials or credits, as each student needs their own profile for scheduling and records.

Contract Duration & Termination: When you purchase a package, you are effectively entering into a service contract that lasts until all lesson credits in that package are used or expire. Once your credits are finished (or expired), the contract ends automatically. You are not tied into any recurring payments or continuing obligations (aside from any booked sessions you’ve committed to). Of course, you are welcome to purchase additional packages to continue lessons, which would form a new contract (on the then-current Terms). If you choose not to continue, you may let your credits run out/expire – there is no formal “termination” needed as the contract will lapse once we have delivered all the lessons you paid for (or once the time to use them has passed).

To ensure fairness and smooth scheduling, please note the following rules for booking and attending lessons:

Advance Booking Requirement: All lessons must be booked at least 24 hours in advance of the start time. Our system will not allow booking a session with less than 24 hours’ notice. (This is to ensure the tutor has adequate preparation time and to avoid short-notice confusion.)

Booking Availability Window: You can schedule lessons up to 28 days in advance. The booking calendar shows available slots within the next 4 weeks. If you have credits and wish to plan further ahead than 28 days, please wait until the calendar extends or contact us if you have a special scheduling request.

Student Lateness: If you know you will be late to a lesson, please inform the tutor via email or the platform if possible. Regardless, the tutor will stay online and available for 20 minutes after the scheduled start time. If you join late, you can use whatever time remains in the session slot – note that we cannot run past the scheduled end time (as we may have other lessons or commitments). If you have not joined the session by 20 minutes past the start time, it will be treated as a no-show (you miss the lesson), and that lesson credit will be deducted as if used. The tutor is not obligated to remain in the call beyond the 20-minute waiting period.

Tutor Lateness: We strive to start on time. If the tutor is a few minutes late due to an unforeseen issue, rest assured you will still receive your full 45 minutes of teaching – we will either extend the lesson into the buffer time or make other adjustments. If for some reason, the tutor loses time (e.g. joins 10 minutes late due to a connection issue), we will make up that lost time either by extending the session (if you are able to) or by adding extra time to a future lesson, as you prefer.

Tutor Cancellations: In the unlikely event that we (the tutor) need to cancel or reschedule a lesson from our side (for example, due to illness or an emergency), we will give you as much advance notice as possible. You will not lose your lesson credit if the cancellation is on our end. We will work with you to reschedule the session to a new time that suits you. If rescheduling is not feasible for you for that lesson (e.g. it was a one-off event or you cannot do any other time), we can offer a refund of that lesson credit at our discretion (typically, we refund the pro-rata value by the same method you paid). We aim to be fair and avoid inconveniencing you – tutor-initiated cancellations are something we try to keep to an absolute minimum.
(In summary: if the tutor cancels, you keep or get back your credit; if you cancel with enough notice, you keep your credit; if you cancel late or don’t show, you lose the credit – see Section 7.)
7. 学生取消与改期;缺席政策;法定冷静期
Self-Service Cancellation/Rescheduling (Booking Policy): We understand plans can change. You may cancel or reschedule a lesson through the online booking system, subject to these rules:

With at least 24 hours’ notice: If you cancel or reschedule more than 24 hours before the lesson’s start time, there is no charge or penalty. The lesson credit will be returned to your account (or remain unused) so you can re-book another time. We do appreciate notice as early as possible so that we can offer the slot to other students, but formally 24+ hours is sufficient.

Less than 24 hours’ notice, or no-show: If you attempt to cancel a session with less than 24 hours remaining, or if you do not show up to the lesson at the scheduled time, that session will be treated as late-cancelled and the lesson credit will be deducted as if the lesson had been taken. In other words, you will lose that credit and are not entitled to a refund for it. This policy is in lieu of any additional fee – we do not charge extra “no-show” fees; the forfeited credit is the sole consequence of a late cancellation.

These cancellation rules apply regardless of the reason (except in truly exceptional circumstances at our discretion – see Section 8). Please understand that a short-notice cancellation means we likely cannot refilled that timeslot, and the tutor has set aside the time and prepared for the lesson. The 24-hour policy is there to balance your flexibility with our need to manage a schedule.
Your 14-Day Statutory Right to Cancel (Consumer Contracts Regulations 2013): If you purchase a package of lessons online, you have a legal right to cancel the purchase and get a refund within 14 days, even if you’ve just changed your mind. This is provided by the UK Consumer Contracts Regulations 2013 (for distance contracts) and works as follows:

Cooling-Off Period: You have 14 days from the day after we confirm your order to cancel the service contract for any reason (no need to give a reason). If you cancel within this 14-day period, you are entitled to a full refund of the package price, provided that we haven’t already fully provided the services (see below).

Requesting Early Service Start: If you schedule or otherwise request lessons to begin during this 14-day cooling-off period (for example, you buy a package and book a lesson for the next day, which is within 14 days of purchase), then you are asking us to start performing the services before the cooling-off period expires. By doing so, you agree to the following:

Express consent: You expressly request and consent that we begin providing the lessons during the 14-day cancellation period. (We will typically have you check a box during checkout or booking to confirm this request.)

Acknowledgement of losing right to cancel after full performance: You acknowledge that if we have fully delivered the service you purchased (i.e. if all the lesson credits in your package have been used up) within the 14 days, then you lose the right to cancel for that package. In practice, this means if you bought, say, a 5-lesson package and you used all 5 lessons within a week, you cannot then invoke the remaining part of the cooling-off period to get a refund – the contract has been completed in that scenario.

Partial use – pro-rata payment: If you exercise your right to cancel after we have begun providing the service but before it is completed, we are entitled to retain (or charge) payment for the portion of services that has been provided up to the point you notify us of cancellation. This will be a pro-rata amount. For example, if you bought 10 lessons and took 2 lessons then decided to cancel within the 14 days, we would refund you the value of the remaining 8 lessons, but you would pay for the 2 lessons taken (at the package rate). If any lesson credits were used or forfeited due to late cancellation under our policy, those count as provided service. We will calculate any refund due accordingly.

How to Cancel within 14 Days: To exercise this statutory cancellation right, you must inform us of your decision to cancel. The easiest way is to email us at contact@samueltutor.com with a clear statement that you wish to cancel, or you can send a letter to the postal address in Section 1. You may (but are not required to) use the Model Cancellation Form provided below – an email containing the same information is sufficient. The effective date of cancellation is when you send us the notice (so we recommend email for speed). We will acknowledge your cancellation request without delay.

Refund Process for statutory cancellation: If you cancel under these CCR rules, we will refund all payments you made for the package (minus any pro-rata deduction for services already provided, as explained above). The refund will be processed within 14 days from the day you informed us of the cancellation. We will refund using the same payment method you used for the purchase, unless we agree otherwise. You will not incur any fees from us for the refund. (Please note: if currency conversion is involved, the refunded amount in your local currency might differ slightly due to exchange rates – we have no control over that.)

Refunds via your original payment method: If you paid using an online payment method, any refund due will be issued to the same payment method originally used for the transaction, via the relevant payment processor. While we will initiate approved refunds within the 14-day window where applicable, processing times may vary depending on the payment provider and your financial institution. Refunds are issued in GBP for the amount received by us. Any currency conversion or exchange rate differences between the original payment and the refund are the customer’s responsibility. We do not charge any additional fees for processing refunds.

Important: The 14-day statutory cancellation right is in addition to our flexible rescheduling policy. It’s mainly designed for new purchases if you change your mind about taking lessons at all. If you simply need to reschedule or cancel an individual lesson, use the self-service system (Section 7, first part). If you want to cancel the entire package and get a refund, and you’re within 14 days of purchase, use the statutory process above.
8. 退款政策(14 天后)与套餐延期
The following terms apply after the 14-day cooling-off period has elapsed, or otherwise outside the scope of your statutory cancellation rights:

No Refunds on Lesson Packages (Post-Cooling-Off): Once the 14-day statutory cancellation period has passed (or after you have started using the package beyond what would be refundable under that policy), the package becomes non-refundable. In plain terms, we do not offer refunds for unused lesson credits after that point. When you purchase a package, you are committing to use those credits within the validity period. This policy is part of the bargain for the discounted package rates we offer. Please purchase packages commensurate with your confidence in continuing; if unsure, start with a smaller package.

After First Lesson Used: As an extra clarification, if you have a package and you use any lesson (i.e. one credit is redeemed or lost to a no-show) after the 14-day window, the remainder of that package is not eligible for refund (except in special circumstances at our discretion, see below). Our packages are priced as a unit and are not meant to be broken up for partial refunds once performance has begun (beyond what the law mandates in the first 14 days).

Discretionary Exceptions: Notwithstanding the above, we do understand that unforeseen situations can arise. While we do not guarantee any refunds outside the legal requirements, we may consider, on a case-by-case basis, extending credits or offering partial refunds in extraordinary circumstances – for example, serious personal illness/injury, bereavement, or other force majeure events that prevent you from taking the lessons you paid for. We would likely ask for some form of evidence (e.g. a doctor’s note) in such cases. Any accommodation is at the tutor’s sole discretion and would be a gesture of goodwill. Our primary approach in such cases is usually to extend the validity of your credits so you have more time to use them, rather than a cash refund, but each case will be evaluated on its merits. The key takeaway: except for the above exceptional scenarios or your statutory rights, all sales are final and non-refundable, so please purchase responsibly.
(The strict no-refund policy is in place to protect our schedule and income predictability. It is not meant to be harsh, but rather to ensure that a booked slot/credit carries some commitment. We believe our rescheduling options and the trial lesson opportunity provide ample flexibility before committing to a larger package.)
9. 技术要求与学习环境
To get the most out of our online lessons, you are responsible for ensuring you meet these technical and environmental requirements before each session:

Required Equipment:
• A stable internet connection with sufficient bandwidth for video calls (if your connection is very poor and causes repeated interruptions, it may count as if the lesson was attended from our side).
• A device capable of running the chosen video conferencing software (ideally a computer or tablet; a smartphone can work but is not optimal for viewing lesson materials).
• Audio: A working microphone (so the tutor can hear you speak) and speakers or headphones (so you can hear the tutor clearly). We strongly recommend using a headset or headphones to avoid echo/feedback.
• Software: The video call application agreed upon – usually DingTalk or Zoom – is installed and updated to the latest version. We will provide meeting links or IDs. Please test the app beforehand. If you prefer another platform (Skype, Google Meet, etc.), discuss it with the tutor in advance.
• Environment: A quiet, reasonably distraction-free environment for the lesson. This means minimal background noise and interruptions. It helps both you and the tutor concentrate. If the tutor determines that the background noise or disruptions on your end make the lesson unworkable (for example, we cannot hear each other), we reserve the right to count the session as a completed lesson (since the time was allocated) even if little progress was made – though we will try to work with you to avoid such situations by rescheduling if problems are apparent early. -
Use of Camera: Whether you turn your webcam on is your choice. Some students learn better with face-to-face interaction, others are shy or have technical limits. We do encourage using the camera if comfortable, as it can enhance communication (especially for pronunciation guidance or when sharing written text). But there is no absolute requirement to be on video. Please note: if technical or environmental factors (e.g. poor audio quality or inability to gauge understanding) make the lesson ineffective without video, the tutor will discuss this with you. Should a lesson become non-viable due to a lack of video plus other audio issues, it may still be counted as taken if the scheduled time was spent attempting the lesson. We’ll always aim to reschedule or find a fix rather than “lose” the lesson, but this is a gentle warning to ensure that at least the audio is high quality.

Prep and Punctuality: It’s recommended to log on a few minutes before the lesson starts to test your microphone and audio. If using a platform for the first time, install it well ahead of time and try a test call. We cannot extend sessions for setup delays on your side beyond the 15-minute buffer.
(These requirements are essentially to make sure our session can proceed smoothly. If you have any doubts about your setup, please contact us beforehand – we may be able to do a quick test with you.)
10. 18 岁以下学生——保障与沟通政策
We take the safety of younger learners seriously. If the student is under 18 years of age, the following terms apply for safeguarding and transparency:

Parental Consent & Contracting Party: If the student is a minor (under 18), a parent or legal guardian must not only consent to the lessons but also enter into the contract on behalf of the minor. That means the parent/guardian is the actual account holder and purchaser of services, and takes responsibility for compliance with these Terms (payment, ensuring the child attends scheduled sessions, etc.). We may ask for confirmation of age and the responsible adult’s contact details at signup.

Adult Supervision: We require that a parent, guardian, or another responsible adult be present or nearby during each lesson session. “Present or nearby” means an adult should be in the same home or location and aware that the session is happening, readily available in case the student or tutor needs assistance. For very young students or at your discretion, the adult can sit in the room or within earshot. For older teens, being elsewhere in the house is fine as long as you periodically check in. This policy is to ensure the student’s comfort and safety (and it often helps keep the student on task as well). It is especially important for the first session, so the student and tutor can be properly introduced with a guardian present. If we discover a lesson is taking place with a minor unattended (e.g. no adult reachable), we reserve the right to pause or terminate the session until a guardian is available.

Recording of Lessons: Students and parents are permitted to audio- or video-record the lessons for personal study use only, if they wish. (Sometimes re-watching a lesson can help reinforce learning.) We (the tutor) will not record any lesson without obtaining your explicit permission beforehand. In general, we do not record lessons on our side. If a legitimate reason arises to request a recording (for example, a trial session that the parent cannot attend might be recorded for the parent to review later), we would ask for written permission and consent from you before doing so. Any recordings that you make must be kept private – they are for the student’s review only and must not be shared publicly or uploaded to the internet (as they may contain our proprietary materials and other students’ voices in group sessions). In group lessons, for privacy reasons, we discourage students from recording unless all participants agree.

No Unauthorised Contact (No “DMs” Policy): All communication between student and tutor outside of live lessons should occur through official channels – either via the booking platform messaging/email or through the parent/guardian. The tutor will not give out personal contact details (social media, private messenger IDs, etc.) to minor students, and we ask that students (and their parents) likewise respect boundaries. This means the tutor will not engage in one-on-one direct messaging or chat with an under-18 student on platforms like WhatsApp, WeChat, Discord, etc. Any necessary out-of-lesson communication (sending homework, scheduling changes, etc.) should include the parent/guardian (for example, via email CC or through the booking system, which the parent can monitor). This policy protects both the student and tutor.

Safeguarding Concerns: If at any point the tutor has concerns about a minor student’s welfare (for instance, something the student says or does that raises a red flag about abuse or harm), the tutor may break confidentiality to alert the parent/guardian or appropriate authorities as required by safeguarding guidelines. This hasn’t been needed to date, but it will be done if necessary for the child’s safety. Similarly, if you (parent or student) have any concerns about the tutor’s conduct, please report it immediately to the contact in Section 1 – we treat such reports with the utmost seriousness.

Our tutoring is meant to help you learn and improve your own skills. We have a strict policy against any form of academic dishonesty. By using our services, you agree to the following:

No Cheating or Plagiarism Assistance: You will not ask, and we will not provide, any assistance that is meant to be submitted as your own work for academic credit if that assistance would violate the rules of your school/exam. This includes (but isn’t limited to) requests to write or substantially compose essays, assignments, or exam answers for you; doing take-home test questions; or completing any work that is supposed to be solely your effort. We also will not impersonate a student or engage in any misconduct, such as taking an exam on a student’s behalf.

Integrity of Tutoring: Our role is to guide and teach. We’re happy to explain concepts, go over practice questions, critique your drafted answers, and help you learn techniques. But we will not simply give you answers to real graded work or otherwise enable cheating. If you’re unsure whether a certain kind of help is allowed (for example, reviewing a past paper or practising similar questions), please clarify your institution’s policy and ask us – we generally err on the side of caution.

Consequences of Misconduct: If we suspect that a student is trying to engage us in academically unethical behaviour – for instance, asking for “help” on a live exam or submitting tutor-provided work as their own – we reserve the right to terminate the session immediately. In such a case, that session’s credit will still be deducted (since the tutor’s time was spent), and we may refuse further bookings from the student. We also reserve the right to withhold any materials or notes from a session if we later learn they were intended to be misused (e.g. we helped with something under false pretences). No refund will be given for sessions terminated or cancelled due to academic misconduct.

Honesty Policy: By booking lessons, you confirm that your intention is to learn and improve your own abilities. If you are a parent booking for a child, you likewise confirm that you expect the tutoring to be conducted ethically and the child’s work to remain their own. If a school or exam board ever inquires about a piece of work or our role, we will cooperate and be truthful (though such a situation is unlikely to arise if the above guidelines are followed).

Restrictions: You agree not to copy or distribute our lesson materials to anyone else without our explicit written permission. This includes not posting them online, not sharing them in other forums, and not selling them or using them to teach others. The materials are tailored for your learning – please respect the work that went into them. If you have friends or peers who are interested, refer them to us rather than forwarding materials.

Recording Use: If you recorded your lessons (as allowed in Section 10), those recordings similarly are for your personal educational use only. Do not upload or share lesson recordings (which could include our voice, image, and materials) on any public platform (YouTube, social media, etc.) without getting our permission. The recordings may contain personal data of the tutor and potentially other students (in group classes), and unauthorised sharing could violate privacy and copyright laws.

Tutor’s Materials Guarantee: We assure you that any materials we provide are either original, appropriately licensed to us, or in the public domain. If we use third-party content (like a textbook excerpt or a news article) as part of a lesson, we do so under fair use/fair dealing or with permission, and such content remains the property of its respective owners. Our license to you covers only the tutor-created portions.

Your Materials: Conversely, any content you (the student) provide or create during lessons (for example, an essay you wrote that we discuss, or a story you tell in a conversation class) remains your intellectual property. We won’t share or publish your work without permission. We may keep copies of student work for record-keeping and teaching purposes (e.g. tracking progress), but we won’t exploit it commercially.
(Simply put: we respect your IP, you respect ours. Use lesson stuff for learning, not for distribution.)
13. After-Lesson Support, Complaints & Dispute Resolution

Ongoing Support: We want you to have a positive experience. If you have questions or require follow-up after a lesson (e.g. you need clarification on homework assigned), you can email us at contact@samueltutor.com. We try to respond to support emails within a reasonable time (typically within 1–2 working days). Minor follow-up questions are welcome and free of charge. If a question requires a more in-depth explanation, we might suggest covering it in the next lesson instead. We don’t offer 24/7 on-call support, but we are happy to help within reasonable limits between sessions.

Complaints Procedure: If you are not satisfied with any aspect of our service, please let us know so we can address it. You can send a complaint by email to contact@samueltutor.com or by postal mail to the address in Section 1. Please describe the issue, when it occurred, and what you’d like as a resolution. We will acknowledge receipt of your complaint within 2 business days and aim to investigate and respond with a resolution or next steps within 14 days (and certainly no later than 30 days). Most issues can be resolved informally and quickly. If it’s something like “I didn’t find the lesson useful” or “I had a scheduling problem,” we’ll work with you (maybe an extra practice, or adjusting the approach). If it’s more serious (e.g. misconduct), we’ll conduct a proper review.

Alternative Dispute Resolution (ADR): In the event we cannot resolve a complaint between us, under UK consumer law, we are required to inform you of an independent dispute resolution option. We are not members of a specific ADR scheme (tutoring isn’t a regulated sector requiring one), but we will provide you with the details of a competent certified ADR entity – for example, Centre for Effective Dispute Resolution (CEDR) or ProMediate UK. We will also let you know whether we agree to participate in ADR for your particular complaint (we generally will consider it if a reasonable solution can’t be reached, but we are not obliged to submit to ADR in every case). We will give you this information in writing (usually by email) once we’ve reached “deadlock” – i.e. we’ve tried to resolve directly and failed. You can also request this information from us at any time by emailing.

ODR Platform (EU only): If you are an EU-based consumer, there is an EU Online Dispute Resolution platform (http://ec.europa.eu/consumers/odr) which can forward your complaint to an ADR body. Your Statutory Rights Are Unaffected: Nothing in these Terms is intended to exclude or limit the rights that you have under mandatory consumer laws. If any part of these Terms contradicts consumer law, that part will be adjusted or disregarded (without affecting the rest of the contract).

Standard of Service – Reasonable Care & Skill: We promise to provide our tutoring services with reasonable care and skill, as required by law (CRA 2015, Section 49). This means we will use our professional expertise to the best of our ability when teaching you, preparing materials, and communicating. We do not guarantee specific results (e.g. passing an exam) since outcomes depend on many factors including your own effort, but we guarantee that the service quality will meet a reasonable standard.

If Something Goes Wrong – Your Remedies: If we fail to perform the service with reasonable care and skill or otherwise breach a term of our contract, you have legal remedies. Under the Consumer Rights Act, you can:

Require Repeat Performance: Ask us to fix it or do the relevant part of the service again, at no additional cost to you, within a reasonable time and without significant inconvenience. For example, if a lesson turned out to be unsatisfactory due to our fault (maybe the tutor was unprepared on the agreed topic), we would redo that lesson or provide an extra session on the topic properly.

Price Reduction: If a problem can’t be fixed or re-performed (or isn’t done within a reasonable time), you may be entitled to a reduction in the price you paid, up to a full refund for that service. For instance, if we were unable to deliver a promised session or portion of the service at all, you could get that money back. Any refund would be made to you within 14 days of agreement and via the original payment method.
These remedies are provided by law and nothing in these Terms will prevent you from exercising them. We, of course, hope to resolve any issues proactively (for example, offering a make-up lesson if needed) before it even gets to a formal remedy. -
Liability for Death or Personal Injury: We do not exclude or limit liability for death or personal injury caused by our negligence. If, hypothetically, during a lesson we gave advice so bad it caused you physical harm (can’t imagine how in an English lesson, but still) or if there were some safety issue in an in-person context, we would be fully liable as the law provides. (All our lessons are online, so physical injury is not really in scope, but this is a standard clause.) We also do not exclude liability for our fraud or fraudulent misrepresentation, or any other type of liability that cannot be limited by law.

Overall Liability Cap: Apart from the types of liability we can’t limit (just mentioned above), and subject to your statutory rights, our total aggregate liability to you for any claims arising under this contract or in relation to our service is limited to the total fees you have paid us in the 12 months preceding the claim. In other words, the maximum money you could recover from us (for things like breach of contract or negligence, except the serious things we don’t cap) is capped at what you paid us for the past year (or the package value, if the contract is shorter). We feel this is a fair balance given the nature of the service. (For example, if you bought a £200 package and something went wrong, our liability would effectively be limited to £200 in damages).

No Liability for Unforeseeable Losses: We will not be responsible for losses that were not reasonably foreseeable to both you and us at the time the contract was formed. This means we cover direct losses and typical damages if we breach the contract, but we do not cover extremely unusual consequences. For instance, if our lesson platform went down and you missed a job interview as a result, or if our tutoring didn’t raise your exam score and you lost a scholarship – those kinds of losses are not things we could have reasonably contemplated or controlled, so we wouldn’t be liable for them. Our service is educational and its benefits vary; we don’t guarantee a particular outcome, and we don’t assume liability for things outside the lessons themselves.

Business Losses: Our service is sold for personal education, not for commercial purposes. If you use our service for any business or professional purpose (for example, we tutor you in Business English, which you use at your job), we will not be liable to you for any business-related losses such as lost profits, lost business opportunities, business interruptions, or loss of business data. (In any event, if you are using it as a business, you wouldn’t have consumer law protection, and our liability cap and exclusions would still apply similarly.)

Events Outside Our Control (Force Majeure): We are not liable for failing to perform or for delays in performing our obligations if such failure/delay is caused by events outside our reasonable control. This includes, for example: technical outages or internet failures, power cuts, natural disasters, serious illness or injury of the tutor, war or civil unrest, government restrictions, epidemic/pandemic impacts, platform server failures, or other “force majeure” events. If such an event occurs that affects a scheduled lesson or our service generally, we will inform you as soon as we can and do our best to mitigate the impact. Typically, this means we will reschedule the affected lesson to another time when the issue is resolved (your credit will be honoured for the new session). If the problem continues over a longer term, we will discuss alternatives with you (including possibly refunding remaining credits if the service can’t be delivered in a reasonable time). Both you and we shall have the right to terminate the contract if a force majeure event makes it impossible to continue, in which case we would refund any lessons that were paid for but not provided. The main point: you won’t lose your money due to events beyond either party’s control, but we aren’t on the hook for damages arising from such events beyond providing a makeup or refund.

No Other Warranties: We do not make any warranty or representation except as expressly set out in these Terms. For example, we do not warrant that “you will definitely achieve a band 8 in IELTS after 10 lessons” – that would be an example of an outcome we cannot guarantee and thus do not promise. We only promise to deliver the service described, with reasonable care and skill.

In short: we will deliver quality tutoring, or you get your money back; we won’t duck responsibility for our mistakes or negligence; however, we don’t pay for extreme or indirect damages and our total financial exposure is limited. Consumers rarely need to invoke this because we strive to resolve issues directly and fairly.)

While we try our best to ensure all information on our site (pricing, availability, lesson descriptions) is accurate and up-to-date, mistakes can occasionally happen. This section covers those scenarios:

Pricing Errors: If a pricing error is discovered in your order (for example, a technical glitch showed a package for £1 instead of £100), we reserve the right to correct the error and either charge the correct price or cancel the order. If it’s an obvious pricing mistake that any reasonable person would recognize as an error, then we are not obliged to honor that price. We will, of course, inform you of the correct price and you can decide if you want to proceed. If you choose not to, or if payment was already made at the erroneous price, we will cancel and refund your order in full. We will do this promptly and explain the situation. Pricing errors are thankfully rare; any such correction will be handled transparently.

Availability Errors: In an online service like this, “availability” mainly refers to lesson slot availability. If due to a sync issue or timing issue, you book a slot that was actually not available (perhaps two people booked the same last spot simultaneously), or if a package was sold that we cannot fulfill, we will let you know as soon as possible. In the case of a double-booked slot, we’ll offer you alternative times. In the case of a sold-out promotion or similar, we might cancel and refund. We also reserve the right to decline an order for services if we have a legitimate reason (for instance, if we suspect fraudulent activity or if we genuinely cannot accommodate a new student due to capacity – though in the latter case, we wouldn’t have allowed purchase, so this is mostly hypothetical).

Website/Software Errors: If a lesson cannot proceed or is severely disrupted due to technical problems on our side (such as the platform malfunctioning or an error in a resource link), we will not count that against your credit. We will reschedule or redo the lesson at no cost to you. If the error is minor (like a typo on a slide that we quickly correct), that obviously doesn’t affect the lesson. This clause is about significant issues that actually impede service delivery – we will make it right by providing the service as intended or refunding if needed.

Notification: In any case where we have to cancel or amend something post-confirmation due to an error, we will notify you promptly by email or phone. We aim to resolve any such issues with minimal inconvenience to you.
(Bottom line: if we make a blatant mistake, we’ll fix it or refund you; we just ask for understanding that honest errors can occur and will be corrected.)

Use of Data: In summary, we use your data to manage your bookings, deliver lessons (e.g. your Skype/Zoom ID to call you), process payments (your payment details are handled securely by third-party processors; we don’t see full card numbers), and communicate with you about your lessons. We may also use your email to send you feedback requests or updates about our services, but you can opt out of marketing emails at any time. We do not sell your data to third parties. We only share data as needed to provide the service (e.g. with the payment processor, or if legally required by authorities).

Data Security: We implement technical and organisational measures to protect your data. For example, the member portal is password-protected and uses HTTPS encryption. We advise you to keep your login details confidential and use a strong password.

Data Retention: We retain student records (contact info, lesson notes, etc.) for as long as necessary to fulfil our service and for a reasonable period thereafter. Our Privacy Policy outlines the retention periods – for instance, we might keep basic contact and transaction records for 6 years for tax and accounting purposes (as required by law), but we may delete or anonymise lesson-specific data sooner if it’s no longer needed. Don’t worry – changes will not apply retroactively to any lessons or packages you have already purchased under an existing contract, except if the change is required by law or a regulatory authority (or if you expressly agree to the new terms). We generally honour the Terms that were in place at the time of your purchase for the duration of that package. For example, if you bought a package when these Terms said 12-month expiry, and later we change the expiry to 6 months, your package still has the 12-month validity; the new rule would only apply to packages bought after the change. We use the word “usually” in our original Terms regarding honouring existing bookings simply to reserve the rare case where a legal requirement might force an update to ongoing services. But as a rule: your purchase is governed by the Terms you agreed to at that time.
